California's New Ban on Intersectional Discrimination

California has long been a leader in protecting employee rights, with robust laws prohibiting discrimination based on a wide array of characteristics. As of January 1, 2025, the state took another significant step forward by explicitly outlawing intersectional discrimination. This crucial legal development means that employers in California can no longer discriminate against an employee based on a combination of two or more protected characteristics.

Under existing law, employers are prohibited from discriminating against someone because of their sex, race, disability, and so on. However, the reality of discrimination is often more nuanced. Individuals often experience prejudice and disadvantage not due to a single characteristic, but because of the unique way their multiple identities intersect, for example, because of the combination of their race and gender.

Why is this change so important?

This new law acknowledges the complex and layered nature of discrimination. Previously, it could be challenging for individuals facing discrimination based on intersecting identities to effectively pursue legal action. For example, if an employee believed they were discriminated against because they are a Black woman, they might have had to argue their case solely under the umbrella of race discrimination or sex discrimination. This could fail to capture the specific and unique prejudice they experienced, which arises from the combination of these identities.

Think about it: the experiences of a Black woman in the workplace might be distinctly different from those of a white woman or a Black man. Intersectional discrimination recognizes this reality. It understands that biases and stereotypes can operate in ways that target specific combinations of protected characteristics.
